UK Airlines Urged to Not Facilitate Illegal Deportations to Rwanda

Независимые эксперты ООН сегодня выразили обеспокоенность по поводу роли британских авиакомпаний и властных структур, регулирующих деятельность воздушного транспорта, в содействии незаконному выдворению мигрантов в Руанду. Просителей убежища высылают в соответствии с соглашением между правительствами Соединенного Королевства и Руанды, а также законопроектом «Безопасность Руанды».

«Даже если соглашение между Великобританией и Руандой и законопроект “Безопасность Руанды” будут одобрены, авиакомпании и авиационные регулирующие органы, содействуя высылке в Руанду, могут быть замешаны в нарушении прав человека, защищенных международным правом, и постановлений суда», – заявили эксперты.

Они подчеркнули, что высылка просителей убежища в Руанду или любую другую страну, где им может грозить выдворение, нарушает право на свободу от пыток или другого жестокого, бесчеловечного или унижающего достоинство обращения.

В ноябре 2023 года Верховный суд Великобритании постановил, что высылка в Руанду нарушает третью статью Европейской конвенции о правах человека, которая запрещает пытки или бесчеловечное или унижающее достоинство обращение и наказание.

«Если авиакомпании и авиационные органы приводят в исполнение решения государства, нарушающие права человека, они должны нести ответственность за свое поведение», – считают эксперты.

«Как подчеркивается в Руководящих принципах ООН по предпринимательской деятельности в аспекте прав человека, авиационные регулирующие органы, международные организации и деловые круги обязаны уважать права человека», – отмечают они.

Эксперты ООН поддерживают контакты с правительством Великобритании, а также с местными, европейскими и международными авиационными регулирующими органами. Международная ассоциация воздушного транспорта (ИАТА) и Международная организация гражданской авиации (ИКАО) также выразили свою обеспокоенность происходящим.

С заявлением в понедельник выступили Спецдокладчик по вопросу о торговле женщинами и детьми Шивон Маллалли, Специальный докладчик по вопросу о правах мигрантов Гехад Мади и Специальный докладчик по вопросам пыток Элис Джилл Эдвардс.

Специальные докладчики входят в состав так называемых «Специальных процедур» Совета по правам человека. Они не являются сотрудниками ООН и независимы от какого-либо правительства или организации. Они служат в индивидуальном качестве и не получают зарплату за свою работу.
