UN Head of Human Rights Concerned About US Law Enforcement Actions Against Protesters in Universities
Верховный комиссар ООН по правам человека Фолькер Тюрк во вторник заявил, что он обеспокоен серией жестких мер, предпринятых для разгона и подавления протестов на территориях университетов в Соединенных Штатах.
«Свобода выражения мнений и право на мирные собрания имеют основополагающее значение для общества – особенно когда существуют острые разногласия по основным вопросам, как, например, в отношении конфликта на оккупированной палестинской территории и в Израиле», – сказал Тюрк.
Уже в течение нескольких недель тысячи студентов американских университетов протестуют против войны в секторе Газа. В последние дни крупномасштабные демонстрации прошли также в университетских городках других стран.
Многие протесты проходят без инцидентов, однако в ряде мест они были разогнаны или подавлены силами безопасности. Сотни учащихся были арестованы. Многих из них впоследствии освободили, другим – предъявили обвинения. В отношении некоторых студентов были введены академические санкции.
Руководство вузов и сотрудники правоохранительных органов должны тщательно выбирать меры по ограничению протестного движения и гарантировать, что такие меры используются только для защиты прав и свобод других лиц или для достижения других законных целей, например поддержания общественного порядка, подчеркнул Тюрк. Он назвал ряд мер, принятых университетами, «непропорциональными».
Тюрк также заявил, что антисемитские, антиарабские и антипалестинские высказывания и действия совершенно неприемлемы.
«Подстрекательство к насилию или ненависти на основании идентичности или взглядов – реальных или предполагаемых – должно быть категорически отвергнуто», – сказал он. «Мы уже видели, что такая опасная риторика может привести к реальному насилию», – добавил Тюрк.
По его словам, случаи подобного поведения должны рассматриваться на индивидуальном уровне. Нельзя принимать радикальные меры против всех участников протестов на основании того, что несколько человек придерживаются неприемлемой точки зрения, считает Тюрк.
«Здесь, как и везде, действия университетов и правоохранительных органов должны основываться на законах о правах человека, позволяющих вести динамичные дебаты и защищающих безопасное пространство для всех», – сказал он.
«У университетов США есть мощная историческая традиция студенческого активизма, горячих дебатов, свободы выражения мнений и мирных собраний», – добавил Тюрк.
Верховный комиссар подчеркнул, что при любых ограничениях свободы выражения мнений и права на мирные собрания нужно руководствоваться принципами законности, необходимости и соразмерности.
