UK Parliament Gives Nod to Law Deporting to Rwanda: UN Rights Advocates Sound the Alarm
В связи с принятием парламентом Великобритании законопроекта «О безопасности Руанды» Верховный комиссар ООН по делам беженцев Филиппо Гранди и Верховный комиссар ООН по правам человека Фолькер Тюрк выразили тревогу: закон может негативно сказаться на ситуации с правами человека и защитой беженцев.
Они призвали британское правительство пересмотреть свой план по высылке просителей убежища в Руанду и вместо этого принять меры для решения проблем, связанных с нелегальной миграцией, на основе международного сотрудничества и уважения прав человека.
Верховный суд Великобритании в прошлом году постановил, что предлагаемая передача просителей убежища в Руанду будет нарушать международное и британское законодательство. Законопроект «О безопасности Руанды (убежище и иммиграция)» и Договор о партнерстве между Великобританией и Руандой не устраняют пробелы в защите прав мигрантов, выявленные Верховным судом, отметили правозащитники.

«Чтобы защитить беженцев, свои обязательства должны выполнять не только страны, соседствующие с кризисным регионом, а все страны», – подчеркнул Гранди.
По его словам, усилия Великобритании направлены на то, чтобы переложить ответственность за защиту беженцев на третьи страны, что создает опасный глобальный прецедент.
«Великобритания может гордиться своей историей эффективного и независимого судебного контроля. Она все еще может предпринять правильные шаги и принять меры, чтобы помочь устранить корневые причины, из-за которых люди вынуждены покидать свои дома, и взять на себя часть ответственности за тех, кто нуждается в защите, вместе с европейскими и другими международными партнерами», – добавил Верховный комиссар по делам беженцев.
Для этого нужна справедливая и хорошо функционирующая система, которая обеспечит доступ к защите для тех, кто в ней нуждается, и возможность возвращения домой для тех, у кого нет законных оснований для пребывания в стране назначения.
Признавая проблемы, связанные с нелегальным перемещением беженцев и мигрантов, правозащитники ООН выразили серьезную озабоченность тем, что законодательство будет способствовать высылке беженцев с ограниченным учетом их индивидуальных обстоятельств и рисков. Они призвали Великобританию продолжать сотрудничество со странами, расположенными вдоль маршрутов беженцев и мигрантов, чтобы усилить их защиту и расширить альтернативы.
«Перекладывая ответственность за беженцев, лишая суды возможности тщательно проверять решения о высылке, ограничивая доступ к средствам правовой защиты в Великобритании и сокращая масштаб внутренних и международных гарантий прав человека для определенной группы людей, новое законодательство серьезно препятствует верховенству права в Соединенном Королевстве и создает опасный прецедент во всем мире», – сказал Фолькер Тюрк.
Реализация законопроекта приведет к тому, что просители убежища, в том числе семьи с детьми, будут в упрощенном порядке направляться в Руанду для подачи своих заявлений о предоставлении убежища в этой стране – без перспективы возвращения в Великобританию. Также будет ограничена возможность оспаривать решения о выдворении. При этом лица, принимающие решения, и судьи должны будут рассматривать Руанду как «безопасную» страну с точки зрения защиты просителей убежища – независимо от каких-либо доказательств обратного, сейчас или в будущем.
Правозащитники также отмечают, что дополнительным поводом для беспокойства является то, что законодательство разрешает правительству игнорировать средства правовой защиты, предусмотренные Европейским судом по правам человека.
